The systemic failure of child welfare agencies to protect vulnerable children from constant physical abuse, increasing sexual abuse, and emotional abuse that leads to lifelong psychological damage and personal injury. According to a December 2025 report written by Clark Kauffman from the Iowa Capital Dispatch, a lawsuit filed by a 20-year-old South Dakota woman shared the reality of this nightmare. As a young child and member of the Santee Sioux Nation, she was permanently separated from her biological family and placed into state custody. Instead of placing her in a safe environment that respected her cultural heritage as required by law, the state negligently placed the four-year-old child and her siblings with a couple that had no ties to the Native American community. The state had also completely failed to perform mandatory criminal background checks, meaning they blindly placed the vulnerable children into the home of a convicted felon with an extensive drug-related criminal history who had previously received a 25-year prison sentence. After being formally adopted, the child suffered years of intense grooming, severe sexual abuse, and emotional abuse at the hands of her guardian. She reported the assaults at age 13, causing an investigation that backed up her claims, but her abuser had fled, avoiding justice entirely. The state’s initial failure to screen its placements left the child with severe lifelong mental health struggles and damage.
