Justice for Kids® — Protecting New York’s Most Vulnerable
New York has one of the largest and most complicated child-welfare systems in the United States. It exists to protect our most vulnerable children, including those who have been physically, sexually, and emotionally abused, yet it has too often failed the very children it was built to serve.
For decades, children throughout New York City and the state have entered foster care and then endured neglect, abuse, or added trauma at the hands of the people responsible for keeping them safe. Behind each number in the system—nearly 15,000 children currently in foster care—is a story, a family, and a childhood that was interrupted. When children are abused by the very system meant to protect them, it is a tragedy.
They deserve better.
At Justice for Kids®, we are not ordinary personal-injury lawyers. We are a national law firm dedicated to representing children harmed by government child protection and foster care systems: children who were hurt, silenced, or forgotten in foster homes, residential facilities, or institutional programs that were supposed to keep them safe.
Our firm is led by Howard M. Talenfeld, a nationally recognized pioneer in children’s rights litigation, and Justin Grosz, a leading New York trial attorney for abused and neglected youth. Together we work to expose systemic failures and win justice for every child who has suffered within the state’s child-welfare network.
Our New York foster care attorneys have seen firsthand how easily children get lost in bureaucracy: moved from one placement to the next, sexually or physically abused while in care, misdiagnosed, over-medicated, or ignored when they ask for help. We bring passion and compassion, along with decades of courtroom experience, to holding public agencies, foster-care providers, and private institutions accountable.
Because in New York, and across the country, justice for kids is not optional. It’s overdue.

A History of Child Welfare Failures in New York
New York’s foster-care system has long reflected both progress and pain. Policy reform has repeatedly collided with bureaucratic indifference, and countless children have paid the price when the system could not protect them. The cases below show what we mean, though there are many others.
Bernstein v. Wilder: Where Accountability Began

The modern reckoning started in the early 1970s with Bernstein v. Wilder, a landmark class-action lawsuit that originally exposed religious based programs in New York and later address chronic under-supervision and systemic harm in New York City’s foster-care network. The plaintiffs were children caught in a maze of agencies and caseworkers, and they alleged that the city’s Department of Social Services had failed in its constitutional duty to keep them safe. The case compelled the city to admit to widespread deficiencies and set the stage for decades of oversight and reform.
Bernstein drew public attention to the state of child welfare, but it also revealed a painful truth that still holds today: the most vulnerable children often disappear in plain sight.
Marisol A. v. Giuliani: Systemic Harm in the City
Roughly two decades later, Marisol A. v. Giuliani (1995) renewed the fight for children.
Roughly two decades later, Marisol A. v. Giuliani (1995) renewed the fight for children. This sweeping class action, filed for thousands of children in New York City’s care, alleged that the City and State failed to shield foster children from abuse, neglect, and repeated placement in unsafe settings. Plaintiffs described appalling conditions: children passed from home to home, physically and sexually abused, denied an education, and forgotten by overwhelmed caseworkers.
The federal court found deep structural flaws in New York’s Administration for Children’s Services (ACS). The settlement that followed brought years of court-appointed oversight, data tracking, and accountability measures meant to reform the child-welfare apparatus. Federal court oversight lasted more than a decade without sustained improvement.
A.M. v. Mattingly: The Next Generation of Reform
By the early 2000s, reports of child deaths and re-abuse were still coming in despite reforms.
By the early 2000s, reports of child deaths and re-abuse were still coming in despite reforms. In A.M. v. Mattingly (2010), a new group of plaintiffs challenged ACS once more, this time focusing on children who were re-abused after the agency did not act on clear warning signs. The case showed that systemic failures persisted even after years of supposed reform.
A.M. v. Mattingly underscored a devastating reality: reforms on paper do not protect children in practice.
The Judith Leekin Case: When Oversight Disappears Entirely
Few tragedies show systemic collapse as vividly as the Judith Leekin case.
Few tragedies show systemic collapse as vividly as the Judith Leekin case. Leekin was a foster and adoptive parent who used four aliases to exploit multiple child-welfare agencies over two decades. She gained custody of at least eleven special-needs children and collected hundreds of thousands of dollars in government payments.
Behind the paperwork was unthinkable abuse: children locked away, denied schooling, starved, and beaten. The case revealed how fragmented oversight and a complete lack of communication between agencies let one woman torture children for years under the state’s watch, until she moved to Florida, where the abuse came to light.
Howard M. Talenfeld, founder of the Justice for Kids® team, played a central role in bringing the whole story to light. He represented ten of Leekin’s surviving adopted victims and fought for accountability, securing more than $27 million in settlements and exposing the agencies’ failures, which led to overhauls of background-check and inter-agency communication protocols. The case became a national warning: without transparency and oversight, the foster-care system can enable the very abuse it claims to prevent.
The Human Cost Behind the Statistics
Today, nearly 14,900 children remain in New York’s foster-care system.
Today, nearly 14,900 children remain in New York’s foster-care system. Every class action, from Bernstein to Marisol A. to A.M. v. Mattingly, and every individual tragedy, like Judith Leekin’s, tells the same unfortunate story: when a system meant to protect causes harm instead, the law becomes a child’s last line of defense.
At Justice for Kids®, we measure progress not by how many reports are filed, but by how many children are finally safe.
Justice for Kids®: A Law Firm Built to Protect Children
Every case at Justice for Kids® starts with one conviction: children deserve more than sympathy. They deserve justice. Ours is one of the few firms in the country that focuses exclusively on representing abused, injured, and disabled children in personal injury cases.
Many firms handle personal injury, but Justice for Kids® is different because we understand the child-welfare system from the inside out: its agencies, its subcontractors, its duties and regulations, and the failures that keep recurring. We represent children not only as individual victims but also as survivors of systemic harm. For decades, our attorneys have been uncovering the hidden patterns of negligence behind preventable tragedies, from overburdened caseworkers and unlicensed foster homes to institutions that ignored signs of abuse for years.
Howard M. Talenfeld: Nationally Recognized Child-Advocacy Leader
Founding partner Howard M. Talenfeld, who has been granted permission to appear in New York courts, has been at the forefront of children’s-rights litigation for over 30 years. A Forbes-recognized attorney and national child advocate, Howard pioneered civil litigation strategies that hold government agencies accountable when they fail to protect children in state care. His landmark cases have led to policy changes and multimillion-dollar outcomes that not only compensated victims but also changed how states treat vulnerable youth.
Howard believes every lawsuit is a step toward systemic reform, and that belief is the foundation of Justice for Kids®. Under his leadership, the firm has grown nationally, including teams in New York, so that our child clients’ suffering and damages are recovered and never go unanswered.
Justin Grosz: Leading New York’s Justice for Kids® Fight
In New York, Justin Grosz leads the charge for Justice for Kids®. He is a passionate, skilled, and creative litigator who has represented children and families in some of the state’s most challenging child-abuse, foster-care, and institutional negligence cases. Known for his tenacity, empathy, and seven- and eight-figure results, he works tirelessly to uncover what went wrong when a child was hurt in the system and to see that the child is vindicated.

Justice for Kids® is not just another plaintiff’s firm. It is a movement of attorneys, former caseworkers, advocates, and families committed to changing how America treats children in care. Families turn to us when other attorneys won’t take their case, because they know we have built our careers fighting the systems most lawyers avoid.

Frequently Asked Questions: Working with a New York Foster Care Attorney
Timelines vary with the complexity of each case and the agencies involved. In general:
- Initial response: New York’s Child Protective Services (CPS) must begin investigating within 24 hours of a report.
- Investigation phase: This typically lasts 60 days or longer, depending on the circumstances.
- Legal process: Serious abuse, neglect, or systemic failures can take months or years to litigate.
Justice for Kids® helps families through every stage, from reporting and investigations to civil litigation. Our attorneys coordinate strategy and, when it helps, work with CPS, law enforcement, and family courts so that a child’s safety, care, and treatment are not delayed.
Protecting a child’s identity and emotional well-being is our top priority. Our New York foster care lawyers request confidential filings whenever possible, advocate for closed hearings, and work with the courts to limit exposure.
If a child has to testify, we seek the protections that therapists and caregivers recommend to safeguard the child’s emotional well-being. We also make sure New York privacy laws and federal child-protection standards are followed, so children are not retraumatized by a process meant to protect them.
Our trauma-informed approach means we work closely with caregivers, therapists, and advocates to cut down on unnecessary interviews and public disclosure.

- Partner with schools, therapists, and healthcare professionals to build comprehensive support for children
Our goal is not only to prove what happened but also to help make sure the child is protected and receives the therapy and services they need.
Every situation is unique, but these materials are often key:

- Counseling records showing behavioral or emotional changes
- School records identifying behavioral, emotional, and academic changes
- Photos, texts, or emails that document neglect or abuse
- CPS or agency reports from prior incidents
- Witness statements from teachers, foster siblings, or relatives
